Terms of Service

Welcome to TyphoonGuard (the “App”), operated by Doug Davis (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the App and related services. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The service

TyphoonGuard is an informational weather-alert tool focused on typhoons, squalls, and related hazards in the Philippines and surrounding areas. All content is provided for information only and is not a substitute for official warnings from PAGASA or any government authority. You should always verify critical safety decisions with official sources.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the App. By using the App you represent that you meet this requirement.

3. Accounts & authentication

You may create an account using email + magic-code verification. You are responsible for keeping your account secure and for all activity that occurs under it. We may suspend or terminate accounts that violate these Terms.

4. Subscriptions & payments

Some features require a paid subscription; what each tier includes is shown in the app. Paid subscriptions are handled entirely by Apple App Store or Google Play (via RevenueCat). We do not collect, store, or process any payment information. All billing questions must be directed to Apple or Google.

Subscriptions renew automatically at the price shown at purchase until you cancel. You can cancel at any time in your Apple or Google account’s subscription settings; to avoid the next charge, cancel at least 24 hours before the current period ends. Cancelling keeps paid features active until the end of the period already paid for. Deleting your TyphoonGuard account does not cancel a subscription — cancellation happens in your Apple or Google account settings (the app links you there).

You may use the App only for lawful, personal, non-commercial purposes. You agree not to:

7. Disclaimers & no warranty

THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ACCURACY, RELIABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

Weather and hazard information is inherently uncertain. You acknowledge that:
  • The App is not an official warning system.
  • Decisions affecting life or safety should be based on official NOAA/JAXA/PAGASA and other government sources.
  • We are not liable for any loss, injury, or damage resulting from reliance on the App.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING ANY CLAIM (OR $10 IF YOU ARE ON THE FREE TIER). WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your violation of these Terms or your use of the App.

10. Governing law & venue

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Collin County, Texas. You consent to the personal jurisdiction of those courts.

11. Changes to these terms

We may update these Terms. We will notify you of material changes through the App or by email. Continued use after the new effective date constitutes acceptance.

12. Termination

We may suspend or terminate your access at any time for violation of these Terms. You may delete your account at any time through the App.
